Rights
1. Fine Art Prints
1.1 Any form of copying requires ownership of the copyright
or authorisation by way of a specific licence from the
right holder. It is the responsibility of all Ionaca
customers to ensure that copyright is fully owned or
authorised for the reproduction of all aspects of the
work including the main image and any form of logos and
decals; and indemnify Ionaca against any claims of copyright.
1.2 We will endeavour to colour match print reproductions
as closely as possible but this cannot be guaranteed.
A4 proofs can be produced in the presence of our customers.
It is highly preferable if the original artwork or an
accurate source print can be provided as an aid to the
proofing process.
1.3 All digital image files that are produced by Ionaca
are physical and intellectual property
of Ionaca. The
copyright
and
intellectual
property of the original artwork belongs to the producing
artist. If prints are the only requirement then
Ionaca may consider waving all fees accept for the printing.
However, if at any time a digital image file
is required,
then a fee is payable in proportion to the required image
size
as well as fees for scanning and transfer to a CD or
DVD. If a giclee print ready image file is required at
any time then a setup fee will also be payable as well
as an hourly charge for additional work if required.
After
Ionaca has produced the first print
of an artwork then
the digital files will not be released for that artwork
under
any
circumstances accept for low resolution promotional
purposes and at the discretion of Ionaca.
1.4 The inks, fine art paper and canvas used in the creation
of giclee prints are of the highest quality available.
Epson papers have also been Wilhelm tested
to resist fading for many years. To further increase
the longevity of your giclee print, do not expose to
direct sunlight or excessive moisture. Prints must be
handled with care at all times using clean cotton gloves.
Illumination conditions in homes, offices, and galleries
do vary and images will last longer when displayed under
lower light levels; likewise, the life of prints will
be shortened when displayed under illumination that is
more intense than 450 lux. Actual print stability will
vary according to media, printed image, display conditions,
light intensity, humidity, and atmospheric conditions.
We do not guarantee longevity of prints. For maximum
print life, display all prints under glass or lamination
or properly store them
1.5 Unless requested otherwise, giclee prints will be
boxed and shipped unframed and rolled in a crush resistant
tube or carton. The total postage cost will be based
on a combination of postage weight, size and the packaging.
Second class postage will normally be used.
2. General
2.1 All customers are advised to arrange adequate insurance
as Ionaca will not accept any direct or indirect responsibility
for damages or losses other than for our materials and
labour charges.
2.2 All images and information on the Ionaca web site
are available for the express purpose of viewing the
web site. No image or portion of any image may be reused
without the express written permission of Ionaca and
the individual artist or the respective legal owner.
All physical artwork is subject to International copyright
laws.
2.3 The placing of any order constitutes an acceptance
of the Ionaca terms and conditions.
2.4 Terms and conditions; prices; specifications, and
information are subject to change at any time without
notice and are available on the Ionaca web site and on
request. You are bound by any changes, additions, or
revisions and should therefore regularly review the Ionaca
Terms and Conditions.
2.5 All trademarks referenced on this web site belong
to their respective owners.
2.6 Ionaca is not responsible for the content of external
internet sites.
3. Financial
3.0 Please contact us for a formal quotation.
3.1 Payment is normally required in advance. We will endeavour to produce an estimate that is as accurate as possible but there may be situations where the final price is more (and sometimes less) than the initial payment.
3.2 We may consider payment on delivery at our discretion.
3.3 A full materials deposit may be required which will be at least 25% of the gross estimate.
3.4 Credit terms for amounts less than £100.00 may also be considered for up to 15 days.
3.5 All goods remain the property of Ionaca until payment has been received in full.
3.6 Ionaca understands and will exercise the statutory right to interest under the Late Payment of Commercial Debts (Interest) Act 1998 if Ionaca is not paid according to these credit terms (www.payontime.co.uk). Any part payment of the debt will go to reduce the amount of the interest first and VAT is not payable on the interest. Interest will be calculated as follows
interest = gross debt x (UK base rate + 8%) x (the number of days late / 365)
3.7 Ionaca will make use of approved alternatives to court to recover unpaid debts before resorting to full legal action.
3.8 As a last resort, Ionaca will use the full extent of English law to recover any unpaid debt plus interest plus all costs incurred in the recovery of the debt including but not limited to the Small Claims Court procedures.
